By accessing or using Kiota's virtual pharmacy platform and related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms apply to all users of the Service, including doctors, patients, pharmacies, and other healthcare providers.

2. Description of Service

Kiota provides a technology platform that connects doctors, patients, and pharmacies to facilitate prescription management, medication ordering, and healthcare delivery. We do not provide medical advice, diagnosis, or treatment. All medical decisions are made by licensed healthcare professionals.

3. User Accounts and Registration

To use certain features of the Service, you must:

  • Create an account with accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be at least 18 years of age (or have parental consent)
  • Comply with all applicable laws and regulations

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Medical Disclaimer

IMPORTANT: Kiota is a technology platform and does not provide medical advice, diagnosis, or treatment. The Service facilitates communication between healthcare providers and patients but does not replace professional medical judgment.

Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read or accessed through our Service.

In case of a medical emergency, contact your local emergency services immediately.

5. Prescription and Medication Services

Prescriptions issued through our platform are subject to:

  • Professional medical judgment of licensed healthcare providers
  • Applicable pharmacy regulations and dispensing requirements
  • Verification of patient identity and prescription authenticity
  • Compliance with controlled substance regulations where applicable

We are not responsible for the quality, safety, or efficacy of medications dispensed by third-party pharmacies. All medications are subject to pharmacy verification and dispensing protocols.

6. Payment Terms

Payment for services and medications is processed through secure third-party payment processors. By making a purchase, you agree to:

  • Pay all charges associated with your use of the Service
  • Provide accurate payment information
  • Authorize us to charge your payment method
  • Understand that all sales are final unless otherwise stated

Prices are subject to change without notice. Refunds are handled in accordance with our refund policy and applicable regulations.

7. User Conduct and Prohibited Activities

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Violate any applicable laws or regulations
  • Impersonate any person or entity
  • Interfere with or disrupt the Service or servers

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Kiota and protected by international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works of the Service without our express written permission.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIOTA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

Our total liability for any claims arising from the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Kiota and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive.

12. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association, except where prohibited by law.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.
